TERMS OF SERVICE
THE ELEVATION AUDIT

1. WHO WE ARE
These terms apply to The Elevation Audit, provided by Nikki Foord trading as Zava Pty Ltd, ABN [52686330997]. In these terms, "we", "us" and "our" means Nikki Foord. "You" means the person purchasing or attending the session.

2. WHAT THESE TERMS COVER
These terms apply when you purchase The Elevation Audit through our website. By completing your purchase you agree to them.
They do not cover Elevation Mentorship, The Elevation Intensive, or any other service. Those are governed by their own terms, provided separately.
3. WHAT THE ELEVATION AUDIT IS
The Elevation Audit is a single private session of ninety minutes, delivered one-to-one, online or in person by arrangement.
It includes:
A short set of questions sent to you before the session.
The ninety-minute session itself.
A written summary sent to you afterwards.
It is a single session. It is not ongoing support, it is not a program, and it does not include contact between or after sessions beyond the written summary.
4. WHAT IT IS NOT
The Elevation Audit is a professional coaching and psychotherapeutic session focused on personal insight and direction. It is not a substitute for medical treatment, psychiatric care, diagnosis, medication advice, legal advice or
financial advice. It is not a crisis or emergency service. If you are in crisis or at risk, contact
000, Lifeline on 13 11 14, or your nearest emergency department.
We do not guarantee any particular outcome, result or change. What you take from the session depends substantially on your own honesty, engagement and subsequent action.
5. BOOKING AND PAYMENT
Payment is made in full at the time of purchase. Your session time is selected after payment. The price is $1,989 plus GST, being $2,187.90 including GST. All prices are in Australian dollars. A tax invoice is issued on purchase.
Your booking is confirmed when payment has been received and a time has been selected through our booking system.
6. ONE PER PERSON
The Elevation Audit may be purchased once per person. It is not available on a repeat or ongoing basis. If you wish to continue working together after the Audit, that is done through Elevation Mentorship. We reserve the right to decline and refund a second purchase by the same person.
7. CREDIT TOWARD ELEVATION MENTORSHIP
If you commence Elevation Mentorship within thirty days of your Audit session, the full amount you paid for the Audit is credited toward the Mentorship fee. The thirty days runs from the date your Audit session takes place, not the date of purchase.
The credit applies only to Elevation Mentorship, cannot be exchanged for cash, and cannot be transferred to another person. It lapses after thirty days.
8. RESCHEDULING
You may reschedule your session once, provided you give us at least forty-eight hours notice before the scheduled start time.
Inside forty-eight hours, the session cannot be rescheduled and the fee is not refundable.
If you do not attend at the scheduled time and have not given notice, the session is treated as delivered and no refund or reschedule is available.
9. CANCELLATION AND REFUNDS
The session is a reserved block of time that cannot be re-sold at short notice. For that reason we do not offer refunds for change of mind once a session has been booked.
If we cancel or cannot deliver your session, we will offer you a new time or a full refund, at your choice.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where we fail to meet a consumer guarantee, you are entitled to the remedies the law provides.
10. YOUR RESPONSIBILITIES
To get the value of the session, you agree to:
Return your pre-session answers at least twenty-four hours before we meet.
Attend at the scheduled time, in a private setting where you can speak freely.
Participate honestly.
If pre-session answers are not returned, the session will still proceed at the scheduled time and the fee remains payable.
11. CONFIDENTIALITY
What you share in the session is confidential and is not disclosed to anyone else, except where: You give us permission.
We are required by law to disclose it. There is a serious and imminent risk to your life, health or safety, or to
someone else's. Disclosure is otherwise permitted or required under our professional obligations.
Notes and records are held securely and handled in accordance with our Privacy Policy and applicable health records legislation.
12. INTELLECTUAL PROPERTY
All materials, frameworks, models, written summaries and content provided remain our intellectual property. They are provided for your personal use. They may not be reproduced, distributed, taught, resold or used commercially without our written permission.
13. RECORDING
Sessions are not recorded by us. You may not record a session, in whole or part, by any means, without our prior written consent.
14. LIABILITY
To the extent permitted by law, and subject to clause 9, our total liability arising out of or in connection with the Audit is limited to the amount you paid for it. We are not liable for indirect or consequential loss, or for decisions you make following the session. You remain responsible for your own choices.
15. PRIVACY
We handle your personal and health information in accordance with our Privacy Policy, available at nikkifoord.com.au/privacy-policy.
16. CHANGES TO THESE TERMS
We may update these terms from time to time. The version that applies to you is the one published at the time of your purchase.
17. GOVERNING LAW
These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state.
