This website is operated by Nikki Foord [trading name and ABN]. In this policy, "we", "us" and "our" means Nikki Foord and any related business entity. "You" means anyone who visits our website, contacts us, registers for an event, purchases a service, or works with us as a client.

We take privacy seriously. We are bound by the Australian Privacy Principles under the Privacy Act 1988 (Cth) and, in relation to health information, by the Health Records and Information Privacy Act 2002 (NSW).

WHAT THIS POLICY COVERS

This policy explains how we collect, use, store, disclose and protect your personal information through our website, our marketing, our events and our services.

Information you give us during a therapeutic or mentorship engagement is handled separately and more strictly, and is covered under the confidentiality terms provided to you as a client. Where this policy and those terms differ, the client terms apply.

WHAT WE COLLECT

Personal information we may collect includes:

Your name, email address, phone number and postal address.

Business or organisation details where you enquire on behalf of a company.

Payment information, including card details processed by our payment provider. We do not store your full card details ourselves.

Information you provide when you register for an event, complete a form, respond to pre-session questions, or contact us.

Technical information about your visit, including IP address, browser type, device, pages viewed and how you arrived at our site.

Sensitive and health information. In the course of providing psychotherapy, mentorship or related services, you may disclose information about your health, relationships, personal circumstances or wellbeing. This is sensitive information and, in some cases, health information. We only collect it with your consent and only where it is reasonably necessary to provide the service you have asked for.

HOW WE COLLECT IT

We collect information directly from you when you complete a form on our website, register for a masterclass or event, book a call, purchase a service, send us an email or message, or speak with us.

We also collect some information automatically through cookies and analytics tools when you use our website.

In limited cases we may collect information from a third party, for example when an organisation books a session on behalf of its staff, or where you are referred to us. Where we do, we will take reasonable steps to make sure you know.

WHY WE COLLECT IT AND HOW WE USE IT

We use your personal information to:

Communicate with you, including confirmations, reminders and follow-ups.

Send you marketing emails and text messages where you have consented.

MARKETING COMMUNICATIONS

If you register for an event, opt in through a form, or become a client, we may send you emails and text messages about our work, events and services.

You can opt out at any time. Every marketing email includes an unsubscribe link, and you can reply STOP to any text message. You can also email us and ask to be removed. We will action it promptly.

Opting out of marketing does not stop essential communications about a service you have purchased or an appointment you have booked.

WHO WE SHARE IT WITH

We do not sell your personal information. Ever.

We share information with service providers who help us run our business, only to the extent they need it. These currently include:

Some of the providers we use store data on servers outside Australia, including in the United States and the European Union. By providing your information to us, you consent to it being stored and processed overseas. We take reasonable steps to ensure our providers handle your information in a manner consistent with the Australian Privacy Principles, but we cannot control the laws of every jurisdiction in which they operate.

COOKIES AND TRACKING

Our website uses cookies and similar technologies to understand how the site is used and to improve it. Some of these are set by third parties including analytics and advertising platforms.

STORAGE AND SECURITY

We store your information in secure, access-controlled systems. We take reasonable steps to protect it from misuse, interference, loss, unauthorised access, modification and disclosure.

No system is perfectly secure. If a data breach occurs that is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner as required under the Notifiable Data Breaches scheme.

HOW LONG WE KEEP IT

We keep personal information only as long as we need it for the purpose it was collected, or as long as the law requires.

Health information and clinical records are retained in line with our professional obligations, which generally require records to be kept for a minimum of seven years from the date of last contact, and in the case of a client who was under 18, until they turn 25.

ACCESSING AND CORRECTING YOUR INFORMATION

You can ask us for a copy of the personal information we hold about you, and you can ask us to correct anything that is wrong, incomplete or out of date.

Email us using the details below. We will respond within a reasonable time, usually within 30 days. There is no charge for making a request, though we may charge a reasonable fee for the cost of providing access in some circumstances. In limited cases we may refuse access, and if we do we will explain why in writing.

COMPLAINTS

If you think we have mishandled your personal information, contact us first using the details below. We will investigate and respond in writing, usually within 30 days.

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au, or in relation to health information in NSW, to the NSW Information and Privacy Commission at ipc.nsw.gov.au.

We may update this policy from time to time. The current version is always available on this page, with the date it was last updated shown at the top.
